LIMITED PRODUCT WARRANTY AND RETURN POLICY
Resync Your Body, LLC (“Resync Your Body,” “Company,” “we,” “us,” or “our”) warrants that the Resync Your Body® Vibroacoustic Chair (the “Chair”) is free from defects in materials and workmanship under normal, intended use for the applicable warranty period as described below. This warranty applies only to the original purchaser and is non-transferable. To exercise your rights under this warranty, you must provide proof of purchase, including the date and location of purchase.
This Limited Product Warranty and Return Policy incorporates, restates, and supersedes all terms and conditions of any prior written warranty and return policy applicable to the Chair. All material terms of the prior policy are fully set forth herein, and this document constitutes the complete and exclusive statement of the warranty and return terms between Company and the purchaser.
WARRANTY COVERAGE
Vibroacoustic Transducer Warranty
The embedded vibroacoustic transducer system is covered by a one (1) year limited warranty from the original date of purchase. During this one-year period, if the transducer is found to be defective under normal, intended use, Company will repair or replace the transducer at its sole discretion. Shipping to the company’s designated service facility is the responsibility of the purchaser. The company will cover the cost of the replacement transducer and labor during the one-year warranty period.
Other Electronic Components
All other electronic components of the Chair, including but not limited to power cords, adapters, control systems, and wiring, are covered by a ninety (90) day limited warranty from the original date of purchase. During this ninety-day period, if any such component is found to be defective under normal, intended use, Company will repair or replace the defective component at its sole discretion. After the ninety-day period, replacement parts and service for these components may be available for an additional fee.
Post-Warranty Transducer Service (After One Year)
After the initial one-year warranty period has expired, the purchaser may elect to have the transducer replaced for an additional service fee, to be determined at the time of request based on current manufacturing, labor, and component costs. All shipping costs (to and from Company’s designated facility) are the responsibility of the purchaser. The company is under no obligation to offer free replacement or repair of vibroacoustic components beyond the one-year warranty period.
INTENDED USE AND WARRANTY EXCLUSIONS
The Company Chair is a non-medical wellness device designed exclusively for seated use to support nervous system regulation, mindfulness practices, breathwork, and relaxation.
Proper Intended Use Includes:
Sitting upright on the Chair; sitting upright with feet placed on the Chair; lying down on the floor with calves placed on the Chair; passive use for mindset, nervous, and fascia system reset, and relaxation sessions; and use consistent with the company’s provided instructions and guidelines.
This Warranty Does NOT Cover:
This warranty is void if damage results from, including but not limited to: sitting on the Chair with a weight higher than 350 pounds; standing on the Chair; kneeling, jumping, or placing excessive weight on the Chair; using the Chair in any position other than those mentioned above; modifying, opening, or attempting to repair internal components; improper electrical connections or use with non-approved power sources; use outside; negligence, misuse, abuse, accidents, or unauthorized alterations.
If damage is determined to be caused by improper or unintended use, no repair, replacement, or return will be accepted, regardless of time since purchase.
SHIPPING AND SERVICE CONDITIONS
All warranty or post-warranty service requires the Chair to be shipped to a Resync Your Body-designated service facility, which will be communicated at the time of the service request. The purchaser is responsible for all inbound shipping costs. The company is not responsible for any damage incurred during shipping resulting from improper packaging.
INSPECTION UPON DELIVERY
The purchaser must inspect the Chair immediately upon delivery. Any visible shipping damage, defects, or discrepancies must be reported to Company within seventy-two (72) hours of delivery by contacting info@resyncyourbody.com. Failure to report visible damage within this timeframe may result in denial of any related warranty or exchange claim. The purchaser should document any damage with photographs prior to contacting Company.
WARRANTY CLAIM PROCEDURE
To submit a warranty claim, the purchaser must: (1) contact Company at info@resyncyourbody.com within thirty (30) days of discovering the defect; (2) provide proof of purchase, including date and location of purchase; (3) provide a detailed description of the defect and, if possible, photographs or video documentation; and (4) obtain a Return Merchandise Authorization (“RMA”) number before shipping the Chair or any component for service. Claims submitted without an RMA number will not be processed. The company will use commercially reasonable efforts to respond to warranty claims within ten (10) business days of receipt and to complete repairs or replacements within thirty (30) days of receiving the Chair at its designated service facility, subject to parts availability.
EXCHANGE POLICY
90-Day Wood Technical Exchange Policy (No Refunds)
The company does not offer refunds once a Chair has been purchased. However, for technical manufacturing issues only, the following policy applies: within 90 days of delivery, a Chair may be returned solely for exchange if a verified technical defect is present with the wood. Upon inspection and approval, the Chair will be exchanged for another unit of the same model at no additional cost, excluding shipping. All shipping costs are the purchaser’s responsibility.
IMPORTANT CLARIFICATIONS
Returns are not accepted for preference, discomfort, misuse, or change of mind. Damage due to improper use voids all return and exchange eligibility. No cash refunds, partial refunds, or credits are offered under any circumstances.
NON-MEDICAL DEVICE DISCLOSURE
The Resync Your Body® Vibroacoustic Chair is a wellness device, not a medical device. It is not intended to diagnose, treat, cure, or prevent any disease or medical condition. It is not a substitute for medical care, physical therapy, or mental health treatment. Purchasers and users assume full responsibility for appropriate use within wellness, recovery, or relaxation contexts.
ASSUMPTION OF THE RISK AND RELEASE
By purchasing and using the Chair, the purchaser and any user voluntarily assume all risks associated with the use of the Chair, including but not limited to risks related to the user’s physical condition, health status, or any pre-existing medical conditions. The purchaser, on behalf of themselves and any users of the Chair, hereby releases and discharges Company, its officers, directors, members, employees, agents, and affiliates from any and all claims, demands, damages, actions, or causes of action arising out of or related to the use of the Chair, except to the extent caused by Company’s gross negligence or willful misconduct. The purchaser acknowledges that they have been advised to consult with a physician or healthcare provider before using the Chair if they have any medical conditions or concerns.
INDEMNIFICATION
The purchaser agrees to indemnify, defend, and hold harmless Company, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) the purchaser’s or any user’s misuse of the Chair; (b) any unauthorized modification, alteration, or repair of the Chair; (c) any breach of this Limited Product Warranty and Return Policy by the purchaser; or (d) any third-party claims related to the purchaser’s or any user’s use of the Chair.
DISCLAIMER OF WARRANTIES
EXCEPT AS EXPRESSLY PROVIDED IN THIS LIMITED PRODUCT WARRANTY, COMPANY MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THIS EXCLUSION MAY NOT APPLY TO YOU.
LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OR INABILITY TO USE THE CHAIR. COMPANY’S TOTAL LIABILITY UNDER THIS WARRANTY SHALL NOT EXCEED THE ORIGINAL PURCHASE PRICE OF THE CHAIR. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
GENERAL PROVISIONS
Governing Law and Jurisdiction
This Limited Product Warranty and Return Policy shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. Any legal action or proceeding arising out of or relating to this Limited Product Warranty and Return Policy or the purchase or use of the Chair shall be brought exclusively in the state or federal courts located in Palm Beach County, Florida. The purchaser hereby consents to the personal jurisdiction of such courts and waives any objection to venue in such courts.
Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to this Limited Product Warranty and Return Policy or the Chair shall first be submitted to good-faith mediation. If mediation is unsuccessful, the dispute shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules. The arbitration shall take place in Palm Beach County, Florida. The arbitrator’s decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
THE PURCHASER AGREES THAT ANY ARBITRATION OR LEGAL PROCEEDING SHALL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, AND THE PURCHASER WAIVES ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
Severability
If any provision of this Limited Product Warranty and Return Policy is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such finding shall not affect the validity, legality, or enforceability of the remaining provisions, which shall continue in full force and effect.
No Waiver
The failure of Company to enforce any term or condition of this Limited Product Warranty and Return Policy shall not constitute a waiver of such term or condition or any other term or condition, nor shall it affect Company’s right to enforce such term or condition at a later time.
Assignment
This Limited Product Warranty and Return Policy is personal to the original purchaser and may not be assigned, transferred, or conveyed to any third party without the prior written consent of Company. Any attempted assignment in violation of this provision shall be void and of no effect.
International Purchases
This Limited Product Warranty and Return Policy applies only to Chairs purchased within the United States. Purchasers outside the United States may not be eligible for warranty service, and the Company makes no representation that the Chair is appropriate or available for use in locations outside the United States. International purchasers are responsible for compliance with all applicable local laws and regulations.
Legal Rights
This Limited Product Warranty and Return Policy provides specific legal rights. Purchasers may also have other rights that vary by state or jurisdiction. We reserve the right to modify this Limited Product Warranty and Return Policy at any time. Any changes will be effective immediately upon posting on our website or as otherwise communicated to you.
